In the early 1980s, a new category of crime appeared in the criminal law lexicon. In response to concerted advocacy-group lobbying, Congress and many state legislatures passed a wave of "hate crime" laws requiring the collection of statistics on, and enhancing the punishment for, crimes motivated by certain prejudices. This book places the evolution of the hate crime concept in socio-legal perspective. James B. Jacobs and Kimberly Potter adopt a skeptical if not critical stance, maintaining that legal definitions of (...) hate crime are riddled with ambiguity and subjectivity. No matter how hate crime is defined, and despite an apparent media consensus to the contrary, the authors find no evidence to support the claim that the United States is experiencing a hate crime epidemic--instead, they cast doubt on whether the number of hate crimes is even increasing. The authors further assert that, while the federal effort to establish a reliable hate crime accounting system has failed, data collected for this purpose have led to widespread misinterpretation of the state of intergroup relations in this country. The book contends that hate crime as a socio-legal category represents the elaboration of an identity politics now manifesting itself in many areas of the law. But the attempt to apply the anti-discrimination paradigm to criminal law generates problems and anomalies. For one thing, members of minority groups are frequently hate crime perpetrators. Moreover, the underlying conduct prohibited by hate crime law is already subject to criminal punishment. Jacobs and Potter question whether hate crimes are worse or more serious than similar crimes attributable to other anti-social motivations. They also argue that the effort to single out hate crime for greater punishment is, in effect, an effort to punish some offenders more seriously simply because of their beliefs, opinions, or values, thus implicating the First Amendment. Advancing a provocative argument in clear and persuasive terms, Jacobs and Potter show how the recriminalization of hate crime has little value with respect to law enforcement or criminal justice. As is the case with most pre‐modern philosophers of India, very little historical information is available about Bhartṛ‐hari. There are many interesting legends, some turned into extensive plays and poems, current about him. However, it is impossible to determine on their basis even whether there was only one philosopher called Bhartṛ‐hari. The appellation “philosopher” could unquestionably be applied to the author or authors of at least two Sanskrit works that are commonly ascribed to Bhartṛ‐hari.

The comorbidity of chronic pain and opioid addiction is a serious problem that has been growing with the practice of prescribing opioids for chronic pain. Neuroimaging research has shown that chronic pain and opioid dependence both affect brain structure and function, but this is the first study to evaluate the neurophysiological alterations in patients with comorbid chronic pain and addiction. Eighteen participants with chronic low back pain and opioid addiction were compared with eighteen age- and sex-matched healthy individuals in a (...) pain-induction fMRI task. Unified structural equation modeling (SEM) with Lagrange multiplier (LM) testing yielded a network model of pain processing for patient and control groups based on 19 a priori defined regions. Tests of differences between groups on specific regression parameters were determined on a path-by-path basis using z-tests corrected for the number of comparisons. Patients with the chronic pain and addiction comorbidity had increased connection strengths; many of these connections were interhemispheric and spanned regions involved in sensory, affective, and cognitive processes. The affected regions included those that are commonly altered in chronic pain or addiction alone, indicating that this comorbidity manifests with neurological symptoms of both disorders. Understanding the neural mechanisms involved in the comorbidity is crucial to finding a comprehensive treatment, rather than treating the symptoms individually. (shrink)

The Report's editorial mandate is both to examine issues of current importance and to invite bioethics to broaden the range of issues it probes. Thus along with articles exploring the relationship between patients and doctors, or health policy, or any of the myriad other familiar concerns of ethics in medicine, from time to time the Report has published articles about public health, animal experimentation, or “environmental ethics” broadly construed. The most recent was the special supplement Nature, Polis, Ethics in the (...) November‐December (1998) issue. Some, of course, have argued that “bio‐ethics” ought always to encompass concern for issues beyond the bedside. When the biologist Van Rensselaer Potter proposed the term bioethics nearly thirty years ago, the field he had in mind lay at the intersection of ethics and the biological sciences in general. In light especially of Nature, Polis, Ethics's call for a substantive “humans‐nature ethics” it seems appropriate, therefore, to invite one of the earliest proponents of a generous understanding of bioethics to reflect on the character of the field and the questions with which it should grapple. Critical theory is construed in very broad terms in Leone, Potter, and Shackel's discussion. It is not restricted to the "critical theory" associated with the Frankfurt school or, latterly, with Habermas. It encom-passes any research program that adopts a critically self-conscious attitude toward its constituent presuppositions: as they describe it, "critical theory asks of any set of conclusions from what point of view they are constructed." To press for such reflexiveness is crucially important, but a number of important things (...) drop out or are left unspecified when "critical theory" is construed this broadly. For example, what is the standpoint of the critical theorist, and to what criteria of acceptability is the exercise of unmasking answerable? What sort of commentary does the unmasking provide on contemporary contexts, and how is one to determine when it is accurate in what it reveals about the conditions and interests informing practice? Leone et al. stop at the point where the most interesting and difficult questions arise. This is not to fault their analysis or their recommendations but to suggest what seem some important avenues for development of their critical initiative that remain to be explored. (shrink)

Seventeen television journalistsfrom Indianapolis and Terre Haute, Indiana encountered a computer simulation of newsgathering, based on Potter's Box. The situation involved showing identijable faces in a story about AIDS testing. Additional information was the most accessed resource. Organizational codes of ethics were accessed the least. Journalism organization members sought more advice from all resources than others. More experienced respondents accessed more advicefrom professional peers. Females were less interested in peer advice than their male counterparts.

This paper comments on some of the different senses of the notion of discourse in the various relevant literatures and then overviews the basic features of a coherent discourse analytic programme in Psychology. Parker's approach is criticised for (a) its tendency to reify discourses as objects; (b) its undeveloped notion of analytic practice; (c) its vulnerability to common sense assumptions. It ends by exploring the virtues of 'interpretative repertoires' over 'discourses' as an analytic/theoretical notion.

This article considers the different approaches to cognition in conversation analysis and discursive psychology. Its points are illustrated through a critical but appreciative consideration of an article by Drew in which he uses conversation analysis to identify ‘cognitive moments’ in interaction. Problems are identified with Drew’s analysis and the conclusions he draws. In particular, he a) presupposes a dualistic division between depth and surface; b) makes circular inferences from conventional conversational patterns to underlying cognitive entities; c) presupposes that the underlying (...) cognitive entities influence conduct. It is argued that none of these things is required by conversation analysis; rather Drew is imposing cognitivist assumptions on conversational materials. Discursive psychology’s approach focuses on cognitive issues in terms of how they are constructed and oriented to in interaction; its virtues are pressed. (shrink)

The aim of this article is to provide a historical response to Michel Janssen’s (2009) claim that the special theory of relativity establishes that relativistic phenomena are purely kinematical in nature, and that the relativistic study of such phenomena is completely independent of dynamical considerations regarding the systems displaying such behavior. This response will be formulated through a historical discussion of one of Janssen's cases, the experiments carried out by Walter Kaufmann on the velocity-dependence of the electron's mass. Through a (...) discussion of the different responses formulated by early adherents of the principle of relativity (Albert Einstein, Max Planck, Hermann Minkowski and Max von Laue) to these experiments, it will be argued that the historical development of the special theory of relativity argues against Janssen's historical presentation of the case, and that this raises questions about his general philosophical claim. It will be shown, more specifically, that Planck and Einstein developed a relativistic response to the Kaufmann experiments on the basis of their study of the dynamics of radiation phenomena, and that this response differed significantly from the response formulated by Minkowski and Laue. In this way, it will be argued that there were, at the time, two different approaches to the theory of relativity, which differed with respect to its relation to theory, experiment, and history: Einstein's and Planck's heuristic approach, and Minkowski's and Laue's normative approach. This indicates that it is difficult to say, historically speaking, that the special theory of relativity establishes the kinematical nature of particular phenomena. Instead, it will be argued that the theory of relativity should not be seen as a theory but rather as outlining an approach, and that the nature of particular scientific phenomena is something that is open to scientific debate and dispute. This article concerns the way in which philosophers study the epistemology of scientific thought experiments. Starting with a general overview of the main contemporary philosophical accounts, we will first argue that two implicit assumptions are present therein: first, that the epistemology of scientific thought experiments is solely concerned with factual knowledge of the world; and second, that philosophers should account for this in terms of the way in which individuals in general contemplate these thought experiments in thought. Our goal is (...) to evaluate these assumptions and their implications using a particular case study: Albert Einstein's magnet-conductor thought experiment. We will argue that an analysis of this thought experiment based on these assumptions – as John Norton (1991) provides – is, in a sense, both misguided (the thought experiment by itself did not lead Einstein to factual knowledge of the world) and too narrow (to understand the thought experiment's epistemology, its historical context should also be taken into account explicitly). Based on this evaluation we propose an alternative philosophical approach to the epistemology of scientific thought experiments which is more encompassing while preserving what is of value in the dominant view. Adaptive success and evolution are determined by how we interact with the natural environment and all other forms of life. Yet in our pursuit to dominate the natural world, we have lost sight of this basic premise and continue to exploit natural resources, to contaminate, to consume more than necessary and to misuse our reproductive capacities. For this reason, global bioethics emerged in the 1980s, a culmination of mental resistance on the part of many observers who sought to readdress the (...) balance between humankind and nature – a balance which must be reinstated if we are to survive. Corrective measures are required, which should be free from purely religious or political influences because their ideologies are frequently founded on strategies of power, with little regard for the general well-being of all living species. Global bioethics, as opposed to bioethics, was formulated by myself, Van Rensselaer Potter, Antonio Moroni, Laura Westra and others, to transcend the restraints of science, uniting it with the humanities to create a new expanded consciousness, an alliance between life and the environment in which all factors – environmental, biological, physical, psychological, social and economic – recognize that they are inderdependent. The vitality of Peirce's ideas has recently stimulated the writing of several books and articles. This is not strictly a revival, but rather the first systematic presentation to the philosophic public of what Peirce hoped was an architectonic philosophy. While some commentators find Peirce's work to consist merely of brilliant fragments of an ultimate failure, Potter believes that Peirce "has achieved a partial synthesis with gaps and inconsistencies, some of which at least can be remedied." In this book (...) class='Hi'>Potter distinguishes for study five aspects of Peirce's philosophy, and some of their relations to one another and to the whole Peirce had in mind. The aspects considered are the categories: Firstness, Secondness, and Thirdness, which can be very roughly characterized as potentiality, actuality, and necessity, or mediating law; the normative sciences of logic, ethics, and esthetics; pragmatism, of which the exposition in the 1870's was only the as yet unconnected beginning; synechism, the cosmology which Peirce thought proved pragmatism; and the Scotistic realism which Peirce felt to be essential to any authentic pragmatism. Peirce's divisions of philosophy correspond to his categories--phenomenology to Firstness and normative science to Secondness. Metaphysics, corresponding to Thirdness, attempts to comprehend the reality of the data of phenomenology and their interpretation by normative sciences. Although in no sense polemical, this careful study contains replies to most standard criticisms of the pragmatic theories of meaning and truth in its explication of the relation of pragmatism to the rest of Peirce's philosophy. In his second section Potter deals with synechism, the principle of continuity, and law, including a strong chapter on "Law as Living Power." The final section treats Peirce's accommodation of continuity and Darwinian evolutionary theory. If growth and development are fundamental throughout the cosmos, Peirce saw that we must admit real chance and its important implications for questions of determinism and mind. Potter makes a close study of Peirce which he shares with the reader, giving insights, and also a glimpse of the process which leads up to them. The concentration on norms and ideals, perhaps less familiar aspects of Peirce's philosophy, may encourage wider investigation of his writings by those who considered him only as a logician or the founder of pragmatism. This is a superior study, and an addition to the scholarly literature on one of America's major thinkers.--M. B. M. (shrink)

Notingasurprising gap in the literature on Wittgenstein’s philosophy (p. 3), Potter sets out to treat Wittgenstein’s 1913 “Notes on Logic” (which consists of a succinct summary of the conclusions reached over this initial period) as an independent and primordial philosophical work. While it has been common for serious scholars of Wittgenstein’s Tractatus to “mine” (p. 1) his pre-Tractarian writings in search of “remarks to support their interpretations ” (p. 1) of that text, what sets Potter’s study of the “Notes” apart from previous attempts at exegesis is a methodological determination to approach the “Notes” as “if not quite … a terminus in Wittgenstein’s work then at least as worthy of study in their own right” (p. 1). An important advantage of this approach, according to Potter, is that it facilitates a clearer appreciation of Wittgenstein’s lasting insights “into the central themes of philosophical logic” (p. 262), many of which Wittgenstein himself had already grasped by 1913 and which survive subsequent rejection of some of the less plausible aspects of the Tractatus (such as logical atomism and the picture theory of propositions). By presenting these key insights as consequences of central, but only subsequently adopted, Tractarian doctrines such as the picture theory, however, traditional Wittgenstein scholarship has missed an opportunity, uniquely important in the case of his philosophy (p. 1), to elucidate them against the background of the actual historical landscape of problems, strategies, motivations, and inXuences, within the context in which they were originally formulated. According to Potter, then, looking at the “Notes” as a Wnished work in its own right, as opposed to a mere collection of preparatory notes, will help us to understand better both the more thorough reasoning Wittgenstein worked through in developing these various insights (subsequently either suppressed or highly compressed in the Wnal draft of the Tractatus itselfy), and just what further logical work that subsequently added elements, such as the picture theory, were supposed to contribute. Likewise, such an approach will help us to understand better the relevant inXuences upon Wittgenstein’s philosophical development, such as those, obviously and respectively, of Frege and Russell. Integral to distilling these various insights and inXuences from the “Notes”, according to Potter, is the process of “disentangling” (p. 3) various extant versions of the text from one another, the distinct versions themselves arising from the “rather complicated circumstances” (p. 3) in which the “Notesz” were composed. Today, DIY -- do-it-yourself -- describes more than self-taught carpentry. Social media enables DIY citizens to organize and protest in new ways and to repurpose corporate content in order to offer political counternarratives. This book examines the usefulness and limits of DIY citizenship, exploring the diverse forms of political participation and "critical making" that have emerged in recent years. The authors and artists in this collection describe DIY citizens whose activities range from activist fan blogging and video production to knitting (...) and the creation of community gardens. The great British biologist J.B.S Haldane counted monotheism's creation of fanaticism as one of the most important inventions of the last 5,000 years. Call it love of God or love of group, it matters little in the end. Modern civilizations spin the potter's wheel of monotheism to manufacture the greatest cause of all, humanity. Before missionary monotheism, people did not consider that all others could be pigeonholed into one kind. The salvation of humanity is a cause as stimulating as (...) it is impossible to achieve. Nevertheless, all modern missionary "-isms," whether religious or in their secular post-Enlightenment guise, preach devotion unto death for the sake of humanity, including allowance for mass killing for the mass good. "The imagination and the spiritual strength of Shakespeare's evildoers stopped short at a dozen corpses. Because they had no ideology," wrote Alexander Solzhenitsyn in The Gulag Archipelago. Especially for young men, mortal combat in a great cause provides the ultimate adventure and glory to gain maximum esteem in the eyes of many and, most dearly, in the hearts of their peers. The COVID-19 pandemic shocked the global economy, with numerous companies suffering losses and shutting down. However, some companies proved to be resilient, being able to sustain their economic performance despite the pandemic. The study aims to explain the sustainable economic performance of companies during the COVID-19 pandemic. The relationships between empowering leadership, innovative work behavior, organizational readiness to change, and sustainable economic performance were assessed. The data were collected via an online questionnaire from January 2021 to March 2021, during the (...) height of the COVID-19 pandemic in Russia. The respondents were Russian companies’ employees holding management positions, competent to objectively assess organizational circumstances during the COVID-19 pandemic. A sample of 337 was used in the analysis. Confirmatory factor analysis (CFA) with maximum likelihood estimation was conducted using SPSS AMOS. The structural model was tested with standardized parameter estimates, standard errors, and p-values calculated. The findings of the study suggest that innovative work behavior and organizational readiness to learn have a direct influence on sustainable economic performance. The findings also suggest that empowering leadership impacts innovative work behavior but not sustainable economic performance. The mediation analysis indicates that innovative work behavior is a mediator between empowering leadership and sustainable economic performance, whereas organizational readiness to learn is not a moderator. The study adds to the leadership and sustainability body of knowledge and contributes to the research on the COVID-19 pandemic in the organizational context. (shrink)

I am delighted that Zachar and Potter have chosen to refer to my work on the DSM-IV cluster B personality disorders in their very interesting and ambitious target article. Their suggestion that we turn to virtue ethics rather than traditional moral theory to understand the relation between moral and nonmoral factors in personality disorders is certainly original and worth pursuing.
